Terms and Conditions

Article 1 – Definitions
The term "Client" refers to the organizer of the program, the legally authorized representative of the company, and/or all participants in the activities offered by Private Boat Tours (PBT).

Article 2 – Scope and Applicability
These general terms and conditions apply to all agreements and arrangements between PBT and the Client in which PBT has declared these terms applicable, unless explicitly modified in writing by both parties. They also extend to agreements involving third parties engaged by PBT in the execution of services.

Article 3 – Partnership Pilot Program Access
PBT provides access to its fleet of classic electric salon boats as part of the Partnership Pilot Program for the period from 1 November 2025 through 31 March 2026, in accordance with the selected partnership level.

Article 4 – Included Services
Each cruise arranged under the Partnership Pilot Program includes the use of a vessel with an experienced skipper, full-service support for planning, branding, catering coordination, and handling of special requests. Depending on the selected partnership package, the following benefits are provided:

Select Partnership Package (€2,700 excl. VAT):

  • 6 luxury cruise credits, each entitling the Client to a 2-hour private cruise and one bottle of Veuve Clicquot.

  • Dedicated skipper.

  • Flexibility to carry over 2 unused credits to Q2–Q4 2026, to be used before 31 December 2026.

Premier Partnership Package (€5,200 excl. VAT):

  • 12 luxury cruise credits, each entitling the Client to a 2-hour private cruise and one bottle of Veuve Clicquot.

  • Dedicated skipper.

  • Company flag produced and installed at the stern, featuring the Client’s logo.

  • Flexibility to carry over 5 unused credits to Q2–Q4 2026, to be used before 31 December 2026.

Article 5 – Fees and Selection of Partnership Package
The fees for each partnership package are fixed, exclusive of VAT. Cruise credits are allocated according to the selected partnership level and are to be used in accordance with these general terms.

Article 6 – Terms of Use
Cruises may be scheduled daily between 09:00 and 00:00, with a minimum booking duration of 2 hours per cruise. Cruise credits are deducted after each cruise, and any transfer or gift of a cruise credit is subject to the same conditions as direct use. Cruises on official holidays are subject to additional fees, which are invoiced in accordance with Article 8 and are charged in addition to the cruise credit.

Article 7 – Additional Services and Extras
Clients may request additional services such as fine dining, professional photography, presentation equipment, live or acoustic music, host/hostess services, and additional beverages or catering. Availability is subject to confirmation. All additional services, consumptions, and holiday surcharges are invoiced separately in addition to the use of any cruise credit, in accordance with Article 8.

Article 8 – Holiday Surcharges
During Christmas (24, 25, and 26 December), New Year’s Eve (31 December), and New Year’s Day (1 January, from 14:00 onwards), an additional fee applies on top of the cruise credit as follows:

Christmas – 24, 25, 26 December

  • Boat with skipper only: before 17:00 – first hour €140, each subsequent hour €80; after 17:00 – first hour €200, each subsequent hour €120

  • Boat with skipper and hostess: before 17:00 – first hour €200, each subsequent hour €160; after 17:00 – first hour €300, each subsequent hour €200

New Year’s Eve – 31 December

  • Boat with skipper only: before 17:00 – first hour €140, each subsequent hour €80; after 17:00 – first hour €200, each subsequent hour €120; from 21:00 onwards – first hour €320, each subsequent hour €220

  • Boat with skipper and hostess: before 17:00 – first hour €200, each subsequent hour €160; after 17:00 – first hour €300, each subsequent hour €200; from 21:00 onwards – first hour €450, each subsequent hour €350

New Year’s Day – 1 January (from 14:00 onwards)

  • Boat with skipper only: first hour €140, each subsequent hour €80

  • Boat with skipper and hostess: first hour €200, each subsequent hour €160

Article 9 – Scheduling and Availability
PBT will make reasonable efforts to accommodate preferred dates and times. Bookings are subject to vessel and crew availability. If a requested time cannot be confirmed, the closest alternative will be proposed. Routes may be adjusted for navigation restrictions or municipal regulations. If the assigned vessel is unavailable, a comparable alternative may be provided or the cruise rescheduled in consultation with the Client.

Article 10 – Cancellations and Rebookings
Cancellation at least 48 hours before the cruise results in the cruise credit being re-credited. Cancellation within 48 hours or a no-show results in one cruise credit being deducted.

Article 11 – Client Liability
The Client is responsible for the conduct of its guests and liable for any damage caused to vessels, equipment, or third parties, including PBT personnel.

Article 12 – Third-Party Services
PBT is not liable for services provided by third parties, such as catering or music.

Article 13 – Complaints
Any complaints regarding activities must be reported immediately to authorized PBT personnel, both verbally and in writing.

Article 14 – Force Majeure
Force majeure includes all events beyond PBT’s control, whether foreseen or unforeseen, that prevent fulfillment of obligations, including adverse weather, municipal restrictions, strikes, or other circumstances. PBT may invoke force majeure even if it occurs after PBT was due to fulfill its obligations. Obligations are suspended during force majeure, and no compensation is owed.

Article 15 – Route and Vessel Adjustments
PBT reserves the right to adjust the route if weather conditions or navigational obstacles require. If the assigned vessel is unusable due to force majeure, an alternative vessel may be provided at PBT’s discretion. Any schedule changes requested by the Client will incur additional charges.

Article 16 – Payments
All fees, including cruise credits, additional services, and holiday surcharges, must be paid within 28 days of the invoice date, unless otherwise agreed in writing. In the event of late payment, the Client is in default by operation of law and owes interest of 1% per month on the outstanding amount, or the statutory interest if higher. PBT reserves the right to suspend further services until payment is received.

Article 17 – Governing Law
These general terms and conditions are governed by the laws of the Netherlands. Any disputes shall be submitted to the competent court in Amsterdam.
