Terms and Conditions
Article 1.
The term “Client” refers to the organizer of the program, the legally authorized representative of the company, and/or all participants in the activities offered by “Private Boat Tours,” hereinafter referred to as PBT.
Article 2.
These terms and conditions apply to every agreement between PBT and the Client in which PBT has declared these terms applicable, unless otherwise agreed upon explicitly and in writing by both parties.
Article 3.
These terms and conditions also apply to agreements involving PBT where third parties are engaged in the execution of the services.
Article 4.
All quotations are made without obligation, subject to price changes, and are valid for 14 days. Costs are based on the proposed program. Any extension of the cruise duration will be charged in the final invoice. Beverages consumed during the cruise will be invoiced based on actual consumption.
Article 5.
The Client is liable for any damage caused to property belonging to PBT or third parties.
Article 6.
The Client is at all times liable for any damage they cause, including damage involving PBT’s equipment and/or personnel.
Article 7.
PBT is not responsible for services provided by third parties (such as catering or music).
Article 8.
If the Client believes that any part of the activity organized by PBT gives rise to a complaint, the Client must report this immediately to authorized PBT personnel, both verbally and in writing.
Article 9.
In these general terms and conditions, “force majeure” includes, in addition to its definition in law and jurisprudence, all external causes, whether foreseen or unforeseen, over which PBT has no control but which prevent PBT from fulfilling its obligations. This includes, but is not limited to, labor strikes at PBT.
Article 10.
PBT is entitled to invoke force majeure even if the circumstance preventing (further) fulfillment occurs after PBT was due to fulfill its obligation.
Article 11.
In the event of force majeure, PBT’s obligations are suspended, and no compensation for damages is owed.
Article 12.
PBT reserves the right to adjust the agreed route if weather conditions or obstructions to waterways, bridges, or locks make such changes necessary.
Article 13.
If the agreed vessel is unusable due to force majeure, PBT reserves the right to provide an alternative vessel. Any additional costs incurred will be borne by PBT.
Article 14.
If the agreed schedule is altered at the Client's request or due to force majeure, any additional costs will be charged to the Client.
Article 15.
If payment is not made in cash, it must be made within 28 days of the invoice date, via a method specified by PBT and in the invoiced currency.
Article 16.
After 7 days from the invoice date, the invoiced amount can no longer be adjusted. After 14 days, the Client is legally in default and will owe interest of 1% per month on the outstanding amount, unless the statutory interest is higher, in which case the statutory interest rate applies.
Article 17.
In the event of the Client's bankruptcy or suspension of payments, all outstanding claims of PBT and obligations of the Client toward PBT become immediately due and payable.
Article 18. Cancellation Policy:
In case of cancellation, a percentage of the invoice amount is due, depending on the notice period prior to the scheduled cruise:
Up to 3 weeks before departure: 25%
Between 3 and 1 week before departure: 50%
Between 7 and 2 days before departure: 75%
Within 48 hours of departure: 100%
